Amina Menkad, Planner provided an overview of the Mississauga Official Plan Review – Bundle 1 Draft Policies. Councillor P. Mullin requested clarification on the guiding principles. Councillor G. Carlson enquired about the future impact to the Official Plan based on the Province's Housing Affordability Task Force legislation. Ms. Menkad and Jason Bevan, Director, City Planning Strategies responded to questions.

Robert Ruggiero, Planner provided an overview of the Mississauga Official Plan Amendment for the Lakeshore Road East Corridor.

The following persons spoke:

  1. Deborah Goss, Resident, Lakeview Ratepayers Association spoke to the community consultation, density and proposed height alternatives. 
  2. Jonathan Giggs, Resident requested clarification on the wide right of way, and enquired about minimum and maximum building heights.
  3. Leo Longo, Aird & Berlis LLP spoke to his written correspondence submitted on behalf of his clients at 1381 Lakeshore Road and enquired about creating an exempt site revision. 
  4. Boris Roselak, Resident expressed concerns regarding privacy and overall impact on the residents.

Committee Members engaged in discussion and spoke to provincial legislation and the OLT. Mr. Ruggiero and Graham Walsh, Deputy City Solicitor responded to questions. Councillor S. Dasko directed staff to put dimensions and minimum setbacks in the built form guidelines, and requested further public consultation for urban design elements. Jason Bevan, Director, City Planning Strategies advised that staff would come back with the zoning and design guidelines, which would include public consultation.

That the applications under File OZ 18-010 W1, 2530173 Ontario Corporation, 1444, 1448, 1454 and 1458 Cawthra Road, to amend Mississauga Official Plan to Residential Medium Density and to add a Special Site policy; to change the zoning to RM6-Exception (Townhouses on a CEC – Road) to permit 4 two storey detached dwellings and 12 three storey townhome dwellings be approved in conformity with the provisions outlined in Appendix 2 of the staff report dated March 4, 2022 from the Commissioner of Planning and Building.
    2. That Council acknowledges that the Commissioner of Planning and Building, in accordance with the Commissioner’s delegated authority, is contemplating imposing the draft conditions of approval outlined in Appendix 3 attached to the staff report dated March 4, 2022 from the Commissioner of Planning and Building for the draft plan of subdivision under File T-M19002 W1.
    3. That the applicant agree to satisfy all the requirements of the City and any other external agency concerned with the development.
    4. That the decision of Council for approval of the rezoning application be considered null and void, and a new development application be required unless a zoning by-law is passed within 36 months of the Council decision.
    5. That notwithstanding subsection 45.1.3 of the Planning Act, subsequent to Council approval of the development application, the applicant can apply for a minor variance application, provided that the height and FSI shall not increase.
    6. Andrea Dear, Development Planner provided an overview of the Rezoning and Draft Plan of Subdivision applications.

The following persons spoke:

  1. Jim Holmes, Resident and President of the Meadowvale Village Community Association expressed concerns with the proposed development and spoke to the Meadowvale Village Community Association previous written submissions regarding the property. Mr. Homes further noted concerns that the proposed development did not conform with the heritage character area. 
  2. Stephen Wolkowich, Resident expressed concerns regarding density, traffic and impact on the heritage character area.
  3. Greg Laughton, Resident expressed concerns regarding density and traffic impact.
  4. Michael Tedesco, Tedesco Engineering expressed concerns regarding traffic.
  5. Greg Young, Resident expressed concerns regarding street A access to Old Derry Road, flooding and heritage impact.
  6. Dave Moir, Resident expressed concerns regarding the construction impact on the natural environment.
  7. Terry Wilson, Resident expressed concerns regarding the impact to the Simpson House and Foreman’s Cottage. Mr. Wilson further spoke to the Historical Significance and requested the retention and preservation of the two properties.
  8. Sue Miller, Resident expressed concerns with maintaining the integrity of the credit river and flooding.
  9. John Bayliss, Resident expressed concerns with the applicant, spoke to the Corporate Report and noted that the proposed development does not conform to the Mississauga Official Plan.
  10. Brian Carmody, Resident expressed concerns about street A, the Credit River Bridges, the loss of trees and heritage impact.
  11. Nishant Sangole, Resident expressed concerns regarding traffic, infrastructure and flooding of the Credit River.
  12. Srikanth Balasubramanian, Resident spoke to the population impact and expressed concerns regarding traffic
  13. Mital Patel, Resident expressed concerns regarding traffic and density.
  14. Indrajit Chatterjee, Resident expressed concerns regarding traffic volume and environmental impact.
  15. Ron Palmer, The Planning Partnership spoke to his written submission and noted support for staffs recommendation. 
  16. Carolyn Wolkowich, Resident spoke to the history of this file and expressed concerns regarding zoning exceptions and the lack of collaboration on this file.

Councillor G. Carlson spoke to the history of the application, the heritage character area, and the OLT process.

    1. That City Council direct Legal Services, representatives from the appropriate City Departments and any necessary consultants to attend the Ontario Land Tribunal hearing on the subject applications under Files OZ 19/020 W11 and T-M19007 W11, Hanlon Glen Homes Inc., and Simqua Developments Inc., 1200 Old Derry Road to permit 260 detached and 62 semi-detached dwellings, a public park, stormwater management block and to retain the existing heritage house all on public roads, in support of the recommendations outlined in the report dated March 4, 2022 from the Commissioner of Planning and Building, that concludes that the proposed rezoning and draft plan of subdivision are not acceptable from a planning standpoint and should not be approved at this time.
    2. That City Council provide the Planning and Building Department with the authority to instruct Legal Services on modifications to the position deemed necessary during or before the Ontario Land Tribunal hearing process, however if there is a potential for settlement a report shall be brought back to Council by Legal Services.
