Meredith Wood, Executive Director, CreativeHub 1352, Paul Michel, Chair, CreativeHub 1352 and Pamela Julian, Director of Strategic Initiatives spoke to organizational activities at the Small Arms Inspection Building  since inception as Lakeview Legacy Community Foundation in 2008, and Small Arms Society in 2018.

Councillors Dasko, Parrish, Damerla,and Tedjo spoke to the success of CreativeHub 1352 and thanked the group for all their efforts, wanting to turn the Hancock Woodlands Building into a drop-in studio for students and expanding the strategic partnership with the City of Mississauga.

Mr. Miskucza spoke to the Notice of Motion for staff to review the Driveway Widening by-laws and spoke to how information is gathered, action being taken, the need for better guidelines, an approval process and the need for enforcement.

Councillors Parrish and Dasko thanked Mr. Miskucza for his comments and spoke to the process of a Notice of Motion, enforcement, grandfathering and current issues with driveways in the City. 

Diana Rusnov, Director, Legislative Services and City Clerk read questions submitted by
Rahul Mehta, resident with respect to item 15.1.

Councillors Parrish and Damerla spoke to the Notice of Motion regarding staff to review the Driveway Widening by-laws and noted the need for staff to keep a list of fines being issued and enquired about the number of applications that go to the Committee of Adjustment who are granted their variances. Geoff Wright, Commissioner, Transportation and Works responded.

    That the report dated March 3, 2023, from the Commissioner of Planning and Building outlining the recommended Section 37 Community Benefits under File OZ 19/004 W5 and File H-OZ 22-8 W5, Bristolwood Developments Limited., 30 Bristol Road East, be approved and that a Section 37 agreement be executed in accordance with the following:

    1. That the sum of $4,000,000.00 be approved as the amount for the Section 37 Community Benefits contribution.

    That a by-law be enacted to establish the lands described in Appendix 1 attached to the report titled Atwood Lane – Establishing Lands as Public Highway (Ward 11), dated March 10, 2023, from the Commissioner of Transportation and Works, as a public highway and part of Atwood Lane and that City staff be authorized to register the by-law on title to the subject lands at the Peel Land Registry Office.

That the Purchasing Agent be authorized to execute the appropriate forms of commitment to V02 Fitness Inc. for the supply and delivery of Octane Fitness, Free Motion, Stages Indoor Cycles, Jacob’s Ladder, Stairmaster, Schwinn, Nautilus, StarTrac, Hoist and Precor Fitness/Peloton commercial equipment, on an as required basis annually and for which funding is approved in the budget for the period of 2023 through to 2027.
    4. That the Purchasing Agent be authorized to execute the appropriate forms of commitment to Liv North (previously National Fitness Products and Advantage Fitness Sales Inc.) for the supply and delivery of Life Fitness, Woodway, Cybex and Hammer Strength equipment, as required, and for which funding is approved in the budget for the period of 2023 and forecasted for the period of 2024 through to 2027.

    Whereas a building permit is not required to widen a driveway;

    Whereas there are regulations that have to be followed based on a variety of zonings for properties which dictate the width of the driveway and minimum soft landscape area required for each zone;

    Whereas when widening a driveway at the boulevard a new curb cut must be requested from the City;

    Whereas the relevant by-law has general provisions that apply to all properties for walkways and setbacks to property lines (subsection 4.1.9 Zoning By-law);

    Whereas adding to the complexity, it is suggested: “if something in the general provisions conflicts with the zoning regulations, follow the zoning regulations”;

    Whereas information on surface treatments of the driveway is in another zoning by-law (article 3.1.1.7);

    Whereas the following disclaimer is included in the printed materials: “The information presented on this web page is provided for information purposes only. It should not be solely relied on when making decisions related to real estate transactions, development proposals or building permits.  We strongly advise you review the text in the official zoning by-law and or speak with City staff before making important decisions.”;
    Whereas the Committee of Adjustment deals with at least five cases of driveway widening every week;

    Whereas thousands of “illegally” widened driveways exist in Mississauga, safe from prosecution, usually investigated on a complaints basis only (see attached for samples);

    Whereas driveways can be widened in an environmentally approved form and should be encouraged as part of the City’s Climate Action Plan (see attached samples);

    THEREFORE BE IT RESOLVED:
    Staff prepare a report for a future General Committee with a review of the driveway widening bylaws, paying particular attention to the following:

    1.    An approximation of the number of driveways in the City that exceed the required widths and other breaches including soft surfaces, extended walkways and other related issues. 

    2.      Total number of complaints and enforcements of driveway by-law breaches investigated by staff over the past 12 months.

    3.     A compilation of the number of prosecutions over the past 12 months with an approximation of staff time involved in driveway investigations and a record of altered driveways as a result. 

    4.    Bench marking with other GTA municipalities regarding by-laws, permits and any other regulations addressing driveway widening.

    5.    A scan of “green” methods of driveway widening that promote rainwater absorption and soft surfacing incorporated into widened driveways and pathways 

    6.     A draft by-law that reflects staff’s findings and recommendations regarding possible legacy exemptions for driveways currently improperly widened,  new and consistent standards for widening driveways, and “green” standards for approval of driveway widening including cost comparisons for different methods.

    WHEREAS the Mayor, Members of Council and staff at the City of Mississauga are deeply saddened to learn of the passing of City employee Donna Van Zutphen, on Sunday March 19th, 2023;

    AND WHEREAS Donna worked for over 20 years with Animal Services as a full-time Shelter Services Officer;

    AND WHEREAS Donna was dedicated to promoting responsible pet ownership, animal welfare and community safety within the City of Mississauga through her dedication to the education of residents and to compliance with by-laws;

    AND WHEREAS Donna was a beloved co-worker with an inspirational work ethic and positive attitude who will be remembered as a knowledgeable and highly respected officer whose caring and concern for animals exemplified all that is best in Animal Services;

    AND WHEREAS Donna will be dearly missed by her sons, Kyle and Dylan Van Zutphen;

    NOW THEREFORE BE IT RESOLVED that sincere condolences be extended on behalf of the Mayor, Members of Council and staff of the City of Mississauga to the family of Donna Van Zutphen

    WHEREAS the Mayor, Members of Council and staff at the City of Mississauga are saddened to learn of the passing of Paul Kernan, a retired City of Mississauga District Chief, who passed away on Wednesday, March 22, 2023.

    AND WHEREAS Paul was with Mississauga Fire Department for 30 years and retired as a District Chief and decorated officer.

    AND WHEREAS Paul was the beloved husband and best friend of Michele of 39 years.  He will be held lovingly in the hearts of his greatest joy, his children, Ben (Lisa Budau) and Adam (Jenna Gaetan)

    AND WHEREAS he will be remembered for his deep passion for serving those around him.  He had an opportunity to combine his life passions with his career as he joined the Mississauga Inferno soccer team travelling the world with his brotherhood, his fellow firefighters.

    AND WEHREAS Paul’s legacy will carry on through the hearts of all whom he touched. 

    NOW THEREFORE BE IT RESOLVED that sincere condolences be extended on behalf of the Mayor, Members of Council and staff of the City of Mississauga to the Kernan family.

    NOW THEREFORE BE IT RESOLVED THAT City Council have closed meetings to the public to be held in the months of April and May to conduct interviews and deliberations related to the recruitment of the City Manager and Chief Administrative Officer position.

    WHEREAS the Mayor, Members of Council and staff at the City of Mississauga are saddened to learn of the passing of John Zipay, former Director, Development and Design, who passed away on March 31, 2023.
    AND WHEREAS John was the beloved husband and best friend of his wife Pamela and father to his children Shawn (Namira), Katherine (Steven), James (Laura) and grandfather to Henry, Serenity, Ron, Gabriel, Noelia, Adeline, Sienna and Nathaniel as well as John’s brother Brian (Diane). 
    AND WHEREAS John worked for the City of Mississauga from February 1989 to February 2004 as the Director, Development and Design in the Planning and Building Department and retired as the Commissioner of Planning for the City of Vaughan in 2011.
    AND WHEREAS he will be remembered as a mentor and friend to many in the planning and development field. 
    AND WHEREAS John always had a smile on his face and enjoyed spending his time with his family enjoying fishing, hunting, swimming, playing darts, going to the cottage, celebrating holidays, golf and travelling.
    NOW THEREFORE BE IT RESOLVED that sincere condolences be extended on behalf of the Mayor, Members of Council and staff of the City of Mississauga to the Zipay family.

Councillor Mahoney enquired about a developer putting up a realtor sign at a property and the confusion the sign has created for residents. Andrew Whittemore, Commissioner of Planning and Building spoke to the regulations of the City of Mississauga Sign By-law and noted that he would report back. Councillor Fonseca spoke to a digital realtor sign on a property in Ward 3. 

Mayor Crombie announced various recognition days, months and events. Councillors Parrish, Tedjo and Damerla announced various Ward and City wide events.
