That the application under File OZ 20/015 W7, Solmar (Edge 3) Corp., 16, 34 and 36 Elm Drive West, to change the zoning to an amended RA5-46 (Apartments) to permit a 12 storey apartment building attached to a permitted 50 storey apartment building in conformity with the provisions outlined in Appendix 2; be approved subject to the conditions referenced in the staff report dated October 1, 2021 from the Commissioner of Planning and Building.
    2. That the applicant agree to satisfy all the requirements of the City and any other external agency concerned with the development.
    3. That the decision of Council for approval of the rezoning application be considered null and void, and a new development application be required unless a zoning by-law is passed within 18 months of the Council decision.
    4. Notwithstanding subsection 45.1.3 of the Planning Act, subsequent to Council approval of the development application, the applicant can apply for a minor variance application, provided that the height and FSI shall not increase.

Mississauga Official Plan Amendment for the Meadowvale Neighbourhood Character Area.

Christian Binette, Development Planner provided an overview of the Mississauga Official Plan Amendment for the Meadowvale Neighbourhood Character Area. Councillor Damerla enquired if the 45 degree angular plane was a requirement or a guideline. Mr. Binette responded and noted that it was a policy requirement. Councillor Saito spoke to community engagement, the 45 degree angular plane and requested an amendment to the recommendation that the policy encouraging podiums be replaced by a new policy that requires taller buildings between 9 and 12 storeys to incorporate podiums.

Due to a conflict of interest, Councillor McFadden departed the meeting at 6:19 PM prior to discussion of item 4.3.

  1. Vidya Basiram, Resident expressed concerns regarding the second access point on Galesway Boulevard, the removal of trees and the traffic impacts.

Tori Stockwell, Development Planner responded to questions and advised that the second access point on Galesway Boulevard was added to accommodate traffic flow. Ms. Stockwell also spoke to the tree preservation area.

Lorie Sterritt, Development Planner provided an overview of the Official Plan Amendment, Rezoning and Draft Plan of Subdivision applications.

The following person spoke:

  1. Julie Daly, Resident spoke to her written submission and expressed concerns regarding the community engagement, site conditions, remediation, and the status of the RSC certificate. Ms. Daly further inquired about inclusive zoning requirements in the Rental Housing Protection by-law.

Chris Rouse, Director, Development and Design and Councillor Carlson spoke to the remediation. Ms. Sterritt advised that the City's Rental Housing Protection by-law came into effect on June 1, 2019 and noted that the demolition permit was issued prior to that date. Graham Walsh, Deputy City Solicitor further advised that the by-law does not call for retroactive enforcement.

    2. That the applicant agree to satisfy all the requirements of the City and any other external agency concerned with the development.
    3. That the decision of Council for approval of the rezoning application be considered null and void, and a new development application be required unless a zoning by-law is passed within 36 months of the Council decision.
    4. That the "H" holding symbol is to be removed from the H-RM5-59 (Street Townhouses) and H-RM9-4 (Back to Back and Stacked Townhouses) zoning applicable to the subject lands, by further amendment upon confirmation from applicable agencies and City Departments that matters as outlined in the report dated October 1, 2021, from the Commissioner of Planning and Building have been satisfactorily addressed.
    5. That notwithstanding subsection 45.1.3 of the Planning Act, subsequent to Council approval of the development application, the applicant can apply for a minor variance application, provided that the height and FSI shall not increase.
    6. That notwithstanding planning protocol, that the report dated October 1, 2021 from the Commissioner of Planning and Building regarding the draft plan of subdivision under file TM20004 W11, NYX Tannery Inc., be considered both the public meeting and combined information and recommendation report.
