Proposed City Initiated Amendments to Zoning By-law 0225-2007.

Roberto Vertolli, Planner provided an overview of the proposed City initiated amendments to Zoning By-law 0225-2007. Committee Members engaged in discussion and enquired about the impact to active files, flat roof drainage, and if planning staff review roof building plans. R. Vertolli and Andrew Whittemore, Commissioner of Planning and Building responded to questions.

    That the report dated July 15, 2022, from the Commissioner of Planning and Building, recommending amendments to the Zoning By-law, proposing revised definitions and regulations, be approved in accordance with the following:

    1. That notwithstanding that, subsequent to the public meeting, changes have been proposed, Council considers that the changes do not require further notice and, therefore, pursuant to the provisions of subsection 34(17) of the Planning Act, R.S.O. 1990, c.P.13, as amended, any further notice regarding the proposed amendment is hereby waived.
    2. That the proposed amendments to Zoning By-law 0225-2007, as detailed in Appendix 3, be approved, and that an implementing zoning by-law(s) be brought to a future City Council meeting.

    That the report dated July 15, 2022, from the Commissioner of Planning and Building outlining the recommended reallocation of Section 37 Community Benefits under Files OZ 16/011 W11 and H-OZ 19/005 W11, City Park (Old Barber) Homes Inc., 5155 Mississauga Road, and OZ 17/020 W11 and H-OZ 21/001 W11, Ravines on Main Inc. (previously City Park (Main Street) Inc.), 36 - 46 Main Street, be approved and that amended Section 37 agreements be executed in accordance with the following:

    1. That $40,000 of the collected Section 37 Community Benefits contribution from OZ 16/011 W11 and H-OZ 19/005 W11, City Park (Old Barber) Homes Inc., 5155 Mississauga Road, be reallocated to an upgraded boulevard treatment (fence installation and tree planting) along the north side of Melody Drive, east of Mississauga Road, extending the depth of the property at 5235 Mississauga Road;
    2. That $8,000 of the collected Section 37 Community Benefits contribution from OZ 17/020 W11 and H-OZ 21/001 W11, Ravines on Main Inc., 36 – 46 Main Street, be reallocated to planters and Streetsville signage and associated hardware;
    3. That City Council enact a by-law under Section 37 of the Planning Act to authorize the Commissioner of Planning and Building and the City Clerk to execute the amended Section 37 agreements with City Park (Old Barber) Homes Inc. and Ravines on Main Inc.

Inclusionary Zoning Affordability Term.

Councillor C. Parrish thanked the public for their previous deputations and noted support for the 99 year affordability term.

The following persons spoke:

  1. Sean Meagher, Resident, Cooksville Community Hub Working Group spoke to the stakeholder round tables, community engagement, set aside rates, the viability of developments, and noted support for the 99 year affordability term.
  2. Tanya Burkart, Peel ACORN expressed concerns regarding the set aside rates, the sunset clause, and policy exemptions. T. Burkart additionally noted support for the 99 year affordability term.
  3. Sonia Wilson, Peel ACORN spoke to the housing crisis and expressed concerns regarding the set aside rates, and not including purpose built rentals. S. Wilson also noted the need to extend the affordability period, and the need for more subsidies from Peel Living.
  4. Becca Cala, Peel ACORN spoke to the housing crisis and expressed concerns about evictions due to discrimination. B. Cala further expressed the need for secure affordable housing and social support.

That the Inclusionary Zoning Official Plan Amendment and Zoning By-law Amendment approved by Planning and Development Committee on July 5, 2022 through Recommendation PDC-0071-2022 (Council Resolution 0153-2022), be amended by changing the affordability term for affordable ownership units to 99 years, and by changing the affordability term for affordable rental units to 30 years, including a 5-year phase out of the affordable rental requirements commencing at year 25, as illustrated in Appendix 1 and 2 to the report titled “Inclusionary Zoning Affordability Term,” dated July 15, 2022, from the Commissioner of Planning and Building.
    2. That four (4) oral submissions be received.

City-Wide Major Transit Station Area Study - Official Plan Amendment. File: LA.07-CIT

Bashar Al-Hussaini, Planner provided an overview of the Official Plan Amendment. Committee Members engaged in discussion and enquired about infrastructure capacity, affordable housing, height limits, and impact to the Lakeshore BRT. Andrew Whittemore, Commissioner, Planning and Building, Luisa Galli, Manager, Planning - Programs, and B. Al-Hussaini responded to questions.

Councillor C. Parrish expressed concerns that numerous objections were received from a wide variety of developers, planners and lawyers indicating more consultation should have been made. Councillor C. Parrish further expressed concerns that transit stations are exactly where we need a concentration of population to get people out of their cars. Councillor C. Parrish also advised that she is not comfortable that Protected Major Transit Station Area (PMTSA) policies are not appeal-able and a process has not been described with details on how individual projects can be reconsidered. 

Councillor C. Parrish and Councillor R. Starr requested that the report be deferred and Councillor D. Damerla requested that the report be considered at this meeting.

The following persons spoke:

  1. Peter Gross, Gowling WLG LLP spoke on behalf of the Ahmed Group and expressed concerns with the Employment Land Designations and the lack of conformity between the Employment Lands in the Region of Peel versus the City. P. Gross further expressed concerns with the height limitations and requested his client's property be removed from the designation. After the fifth person spoke regarding this Item P.Gross returned and spoke on behalf of 590816 Ontario Inc. and noted that his client currently has applications in process. P. Gross further expressed concerns regarding removing intensification corridors, and removing that tall buildings should be within Major Transit Station Areas from the Official Plan.
  2. John Lohmus, Plan Logic Consulting Inc. spoke on behalf of his client The Mississauga Muslim Community Centre and expressed concerns regarding the height limitations, and lack of consultation.
  3. Stephen Sparling, Dundas Land-Owners Association spoke to the written submissions made by Goodmans LLP. S. Sparling expressed concerns regarding land use and height limitations. S. Sparling further advised that the Dundas Land-Owners Association is opposed to the proposed amendments as it relates to the Dundas Corridor and would like to be included on the consultation process.
  4. Glen Broll, GSAI expressed concerns regarding the policies not being appeal-able, and the height limitations. G. Broll requested the report be deferred and enquired about looking into transition clauses for applications currently in process. 
  5. Mary Flynn-Guglietti, McMillan LLP spoke on behalf of SmartCentres Inc. and expressed concerns about height limitations and policies not being appeal-able. M. Flynn-Guglietti spoke to the need for higher densities in Major Transit Station Areas and requested that the report be deferred.

Committee Members engaged in discussed and enquired about timelines, grandfathering applications currently in process, and bench-marking height limitations with other municipalities. Jason Bevan, Director, City Planning Strategies, L. Galli, and B. Al-Hussaini responded to questions.
