    3. That in accordance with the delegated authority under By-law 1-97, City Council acknowledges that the Commissioner of Planning and Building intends to approve the Draft Plans of Subdivision under Files T-M19003 W10 and T-M19004 W10, subject to the sets of draft conditions of approval outlined in Appendices 3 and 4 of the staff report dated November 22, 2023 from the Commissioner of Planning and Building.
    4. That City Council direct the applicant to satisfy all requirements of the City and any other external agency concerned with the development.
    5. That City Council’s approval of the rezoning application be considered null and void, and new development applications be required unless a zoning by-law is passed within 36 months of the Council decision.

Councillor Damerla expressed thanks to staff in trying to resolve outstanding issues; and noted that this application has been appealed to the Ontario Land Tribunal (OLT) and is hopefully that a resolution can be achieved with a process to next steps;

That City Council direct Legal Services, appropriate City staff and any necessary consultants to attend the Ontario Land Tribunal (OLT) hearing in opposition to the Official Plan Amendment and Rezoning applications, under File OZ/OPA 22-17 W7, in their current form, for the lands at 65-79 Agnes Street and for Legal Services to bring a report to Council should there be a potential for settlement.
    2. That City Council authorize the Planning and Building Department to instruct Legal Services on requesting mediation or to otherwise enter into settlement discussions during or before the Ontario Land Tribunal hearing process.

Proposed Amendments for Outdoor Patios and Outdoor Retail Sales and Display
File: BL.09-PAT (All Wards)

Trista James, Planner, provided an overview of the Proposed Amendments for Outdoor Patios and Outdoor Retail Sales and Display and spoke to proposed amendments to staff’s recommendation as outlined in the Corporate Report.

Councillor Dasko spoke in support of the Proposed Amendments for Outdoor Patios and Outdoor Retail Sales and Display; explained the rationale to add to the recommendation regarding waiving of Committee of Adjustment fees for Minor variances related to existing seasonal patios.

In response to Councillor Mahoney’s enquiry regarding capping parking spaces in plazas, Jordan Lee, Supervisor Zoning Services, explained that parking spaces can be capped at specific properties.

Lia Magi, Legal Counsel, explained that Council can direct staff to look into whether any sites are appropriate for exclusion and noted that if there were no sites specified for exclusion in the by-law, any request to add a site for exclusion after the passing of the by-law would have to be an amendment to the by-law.

In response to Councillor Mahoney’s enquiry regarding direction for staff to exclude one site from the by-law, Jordan Lee, Supervisor Zoning Services, explained that the temporary outdoor Patio Program expires on December 31, 2023.

Chris Rouse, Director, Development and Design, suggested that a 10% cap on any particular property, rather than adding site-specific exclusions, and explained the authorization process.

Councillor Parrish suggested that prior to the Council meeting on Wednesday, staff from Planning and Legal meet with her and Councillor Mahoney to review specific sites of concern in their respective Wards, and consider a recommendation suitable across the City.

In response to Councillor Kovac’s request for clarification regarding whether patios in the city centre are permitted as of right and whether patios would be allowed on sidewalks and roadways, Jordan Lee, Supervisor, Zoning Services clarified that patios in the downtown core are permitted as of right, and that patios erected on sidewalks or roadways would require an encroachment agreement or patio permit.

In response to Councillor Dasko’s enquiry regarding whether plaza’s could be removed from the recommendation at this time, and allow staff and the Councillors to meet before Wednesday to come up with solutions regarding patios in Plazas, Jason Bevan, Director, City Planning Strategies, advised that staff could create criteria for plazas whether it be a percentage, number of parking spaces or businesses, to address the concerns that have been raised.

In response to Councillor Horneck’s enquiry as to whether existing patios can be grandfathered, Trista James advised that it is her understanding that permissions under the Temporary Use By-law cannot grandfathered.

Lia Magi, Legal Counsel, advised that staff would have to review the Temporary Use By-law to determine if there are provisions to allow existing uses to continue and that staff would review this before the Council meeting on Wednesday.

The following person spoke:

  1. John Pappas, Chair of the Port Credit Business Improvement Area (BIA), spoke in support of patio program and requested that the process to obtain a minor variance be expedited.

In response to Councillor Mahoney’s direction to staff to have recommendation wording that addresses the issues at plazas/malls, Jason Bevan, Director, City Planning Strategies advised that staff would have recommendation wording for Council’s meeting on Wednesday.

    That the proposed amendments to Zoning By-law 0225-2007, as detailed in Appendix 3, and other City by-laws, as detailed in the report dated November 22, 2023, from the Commissioner, of Planning and Building, be approved in accordance with the following:

    1. That implementing by-laws be enacted at a future City Council meeting, including by-laws that would allow seasonal outdoor patios and seasonal outdoor retail sales and displays to operate with waived fees for a period of two years until December 31, 2025.
    2. That notwithstanding planning protocol, that this report regarding the proposed Zoning By-law 0225-2007, be considered both the public meeting and a combined information and recommendation report.
    3. That the Committee of Adjustment fees for Minor Variances related to existing seasonal outdoor patios be waived for a period of two years until December 31, 2025.
    4. That the notice requirement under ss.7(2)(f) of the Noise Control By-law 0360-1979, as amended, be waived until January 1, 2026 for any person operating a seasonal or long-term outdoor patio who applies for an exemption from section 4 of the By-law as it relates to prohibited periods of time listed in Column 2, section 3 of Schedule 2 or Column 2 of Schedule 2-A.
    5. The one oral submission be received.
