Jordan Lee, Planner provided an overview of the Proposed City Initiated Amendments to Zoning By-law 0225-2007. Councillor P. Saito enquired about asphalt, accessory structures, lot coverage and encroachments. Councillor S. Dasko enquired about the mansard type roofs. Mr. Lee responded to questions.

Mila Yeung, Planner Proposed Minor Zoning By-law Amendment Application Process. Committee Members engaged in discussion and enquired about the scoped studies and the criteria for the application intended for small scale developments. Ms. Yeung and Chris Rouse, Director, Development and Design responded to questions.

Andrea Dear, Planner provided an overview of the Official Plan Amendment, Rezoning and Draft Plan of Subdivision applications.

The following persons spoke:

  1. Michael Matheson, Resident expressed concerns regarding parking spaces and the set back.
  2. Catherine O'Connor, Resident spoke to her written submission and noted concerns regarding the height of the proposed development.
  3. Joey Pais, Resident noted support for the concerns the previous speakers raised and noted additional concerns with traffic, safety, privacy, and parking. 
  4. Rachel Wong, Resident expressed concerns regarding overall traffic safety in the area, and with the timing of the original traffic study.
  5. Devendra Tiwari, Resident expressed concerns with privacy, and traffic safety.
  6. Saima Sheikh, Resident expressed concerns with traffic safety, the proximity of the entrance and exit, density, and scale.
  7. Xiaodong Qin, Resident expressed concerns with the proposed height, density, privacy, and crowded schools.
  8. Lazardo Cardozo, Resident expressed concerns with the height, school bussing issues and the risk to children's safety. 
  9. Ronak Nagda, Resident expressed concerns with the noise impacting wildlife, increased emergency services calls, increased loitering in the neighbourhood, height and parking. 
  10. Jim Levac, GSAI spoke to the height of the proposed development, studies completed, traffic impact, parking needs, and provided example images of a similar existing property in the area. Mr. Levac further elaborated on the site plan approval process with respect to the additional landscaping to help with privacy.
  11. Leo Longo, Aird & Berlis LLP noted support for the staff report and Ms. Dear's presentation.

Committee Members engaged in discussion and spoke to the City Planning and OLT process. Committee Members further advised that the Province would have the final decision on this matter. Ms. Dear and Michal Minkowski, Legal Counsel, Litigation and Planning responded to questions.

That City Council direct Legal Services, representatives from the appropriate City Departments and any necessary consultants to attend the Ontario Land Tribunal hearing on the subject applications under File No. OZ 20-14 W11 and T-M20003 W11, City Park (McLaughlin) Inc., 6616 McLaughlin Road to permit a six storey condominium apartment building and five detached homes in support of the recommendations outlined in the report dated February 11, 2022, from the Commissioner of Planning and Building, that concludes that the proposed official plan amendment, rezoning and draft plan of subdivision are acceptable from a planning standpoint and should be approved subject to the provisions outlined in Appendix 2, and that the draft plan of subdivision under File T-M20003 W11, be approved subject to the conditions referenced in the staff report dated February 11, 2022 from the Commissioner of Planning and Building.
    2. That City Council provide the Planning and Building Department with the authority to instruct Legal Services on modifications to the position deemed necessary during or before the Ontario Land Tribunal hearing process.
    3. That City Council classify the subject lands as a “Class 4 Area” in accordance with the Environmental Noise Guidelines – Stationary and Transportation Sources – Approval and Planning (NPC – 300).
    4. That the applicant agree to satisfy all the requirements of the City and any other external agency concerned with the development.
    5. That notwithstanding subsection 45.1.3 of the Planning Act, subsequent to Council approval of the development application, the applicant can apply for a minor variance application, provided that the height and FSI shall not increase, and that landscape buffers are not reduced.
    6. That eleven oral submissions be received.

Committee Members engaged in discussion and enquired about the incorporating a general percentage increase in building size permissions into the Official Plan and enquired about the NYE Manufacturing minor variance applications example. Mr. Phillips responded to questions.
