Dana Anderson, MHBC Planning provided an overview of the Official Plan Amendment and Rezoning applications.

The following persons spoke:

  1. Ed Praulins, Resident, expressed concerns with intensification, height, privacy, parking, and service area. E. Praulins further expressed concerns with this development setting a precedent on Lakeshore Road. 
  2. Mary Simpson, President, TOPCA, expressed concerns with the height, the overlook, parking, lack of accessibility for garbage pick-up, and not meeting the distance separation requirements.

Committee Members engaged in discussion and expressed concerns about parking, height, privacy, impact to the streetscape and lack of onsite garbage collection. Councillor S. Dasko spoke to the community engagement and noted that he is not in favour of the proposed applications.

Chris Rouse, Director, Development and Design spoke to the planning process and advised that staff would report back to the Planning and Development Committee with a recommendation report for consideration.

Robert Ruggiero, Planner provided an overview of the Rezoning and Plan of Subdivision applications.

The following person spoke:

  1. Tonya Elmazi, President, OHHA spoke to affordable housing and noted concerns with the lot width, the impact on the character of Orchard Heights and the timing of the development. 

Committee Members engaged in discussion and enquired about setback regulations and lot frontages. Hugh Lynch, Manager, Development South responded to questions.

Councillor C. Parrish noted support for the applications. Councillor S. Dasko noted that he could not support the applications as is.

    1. That the applications under File OZ 19/014 W1, Elm Cormack (2017) Inc, 1583 Cormack Crescent to change the zoning to R16-Exception (Detached Dwellings on a CEC-Road) and the draft plan of subdivision under file T-M19005 W1, be approved subject to the provisions outlined in Appendix 2 of the staff report dated May 27, 2022 from the Commissioner of Planning and Building.
    2. That Council acknowledges that the Commissioner of Planning and Building, in accordance with the Commissioner’s delegated authority, is contemplating imposing the draft conditions of approval outlined in Appendix 4 attached to the staff report dated May 27, 2022 from the Commissioner of Planning and Building for the draft plan of subdivision under File T-M19005 W1.
    3. That the applicant agree to satisfy all the requirements of the City and any other external agency concerned with the development.
    4. That the decision of Council for approval of the rezoning application be considered null and void, and a new development application be required unless a zoning by-law is passed within 36 months of the Council decision.
    5. That notwithstanding subsection 45.1.3 of the Planning Act, subsequent to Council approval of the development application, the applicant can apply for a minor variance application provided that the height and number of dwelling units shall not increase.
    6. That one (1) oral submission be received.

That the Chief Procurement Officer or designate be authorized to execute a contract amendment and all ancillary documents to increase the value of the contract (File Ref PRC002730) to $195,000 (original contract value of $71,365 + additional increase of $123,635 = new contract value of $195,000) with Matrix Solutions Inc. (PO 4600018061) for consulting services related to Phases 2 and 3 of the SPA Update.
    2. That the Chief Procurement Officer or designate be authorized to extend the Agreement beyond its current expiry date of March 31, 2022, for an additional term of up to three (3) years, subject to satisfactory pricing, terms and performance.
    3. That staff be directed to proceed with the recommended approaches to updating the Dundas Street Special Policies Areas as outlined in the corporate report titled “Dundas Street - Special Policy Areas Update” dated, June 6, 2022, from the Commissioner of Planning and Building.
