SmartCentres Mixed Use Proposals: Update on Employment Conversion Requests and Draft Policies

Christian Binette, Planner provided an overview of draft policies for the SmartCentres sites and highlighted the feedback from the community and the project timelines.

The following persons spoke:

  1. Christine Fang-Denissov, Urban Strategies spoke in support of the staff's recommendations and noted that a request for conversion of the SmartCentre sites was filed; however, to date, no development application has yet been submitted. Fang-Denissov outlined the principles for the envisioned transformation, and an overview of the review, consultation and community engagement process.
  2. Sean Ramit, Resident; noted that Ward 10 residents are also impacted by proposed developments of the SmartCentre site in Ward 9. Mr. Ramit expressed concerns regarding the impact of reducing the retail footprint that may cause higher retail prices and/or overcrowding forcing residents to go elsewhere to shop and seek employment. Ramit emphasized the need to have consultation with residents of Ward 9 and Ward 10 as part of the criteria to move forward, and further emphasized the need to explore more affordable housing ownership options.
  3. Harbinder Khangura, Resident spoke to housing targets and enquired why Council would consider the conversion of employment to mixed use lands at site 1, given the community's opposition. Khangura noted that the request for conversion does not meet the Municipal Consent Requirements that was in effect when the request for conversion was filed, and further noted that the community would like to view the findings of the consultants assessment report from the community’s engagement, that the Region of Peel was to have made available in June 2024.

Councillor Horneck spoke in support of staff's recommendation for site 2 and 3 and agreed with staff that no conversion be allowed for site 3 as there is a large area of industrial facilities. 

Christian Binette, Planner responded to enquiries from Councillor Tedjo regarding affordability requirement ratio; one-to-one retail replacement; policies of replacement of non-residential for site 2 and for site 1; consultation process with the community; and whether development would be allowed to commence without securing funding for all day, all way GO transit service.

Proposed City-Initiated Amendments to Mississauga Official Plan and Zoning By-law 0225-2007

Trista James, Planner provided an overview of the proposed City-Initiated Amendments to Mississauga Official Plan and Zoning By-law which clarifies wording, revised definitions, removed outdated Rules and addresses new planning trends and laws.  Ms. James highlighted proposed key changes with respect to transitional housing, ancillary crisis shelters, and retail store seating for food consumption.

Councillor Dasko noted that in addition to consultation with the Ward Councillor, that ancillary shelters be located in transit friendly areas.

In response to Councillor Dasko's enquiry regarding whether the increase of retail store seating for consumption affects Payment in Lieu of Parking (PIL), Jordan Lee, Manager, Zoning Initiatives, advised PIL is dependent on Gross Floor Area (GFA) and that there is no proposed increased to the GFA; therefore, not affecting PIL.  Mr. Lee provided an explanation for the meaning of the acronym PIL and the process for PIL which applies to certain areas of the city.

In response to Councillor Tedjo's enquiry regarding what conditions define severe weather, in our region, and whether these amendments provides any protection for places such as places of worship who provide shelter to the homeless, and face insurance related issues, Trista James, Planner advised that notification from Environment Canada is what is relied upon; however, if merited, staff would look at broadening the scope for other sources; and further advised that staff would respond back on insurance coverage protection.

In response to Mayor Parrish's enquiry on whether the amendments would allow for smaller retail spaces to increase seating space and parking spaces, Jordan Lee, Manager, Zoning Initiatives advised that staff will look at specifying certain sized retail be permitted to increase seating and, that it be reflected on the Recommendation Report.

Jaspreet Sidhu provided an overview of the Official Plan Amendment and Rezoning applications.

The following person spoke:

  1. Grant Mason, Urban Strategies, spoke on behalf of the applicant and provided an overview of the proposed development attributes and proposed amendments and noted that there were previous application resubmissions for the development of two buildings; however, after responses from the City and the community, the proposed development has been consolidated into one building.

Councillor Fonseca enquired regarding shared green space amenities; plans for resident and visitor parking; and providing updates to residents;

Grant Manson, Urban Strategies described the plan for the central amenity area and a plan for improvements throughout the area and advised that there is ongoing consultation with the community.

Debgang Chen, Lea Consulting, spoke to the parking study conducted for the existing two buildings to obtain forecast of future demands of residential and visitors parking.

Jonathan Famme, Planner, provided an overview of the proposed Official Plan Amendment highlighting the area context, background, and evaluation.

In response to Councillor Kovac's enquiry, Jonathan Famme, Planner clarified the timelines regarding the Dufferin-Peel Catholic District School Board initial and subsequent updated response and those of the Peel District School Board; and confirmed there is an opportunity through a future rezoning application for discussions between the school board and interested parties to work out the details.

The following persons spoke:

  1. Josh Neubauer, Urban Strategies spoke on behalf of the applicant and provided an overview of the Oxford Square One Lands, Rathburn District OPA and Oxford Block 22 proposal for redesignation.
  2. Iwona Maciata, Resident expressed concerns of overcrowding, traffic congestion, an increase in crime and decreased property value.

Councillor Kovac advised that it would be appropriate for further communication with the landowner regarding the proposed amendments and recommends that this matter be deferred.

Lucas Petricca, Planner, provided an overview of the rezoning and draft Plan of Subdivision applications.

The following persons spoke:

  1. Jim Levac, Partner, Glen Schnarr & Associates Inc. provided background of the subject lands, described similar projects that have been approved, and explained the lands to be transferred to the City of Mississauga to protect the natural heritage system, private amenity spaces, and lands for the development of the condominium.
  2. Nicco Totino, Resident, expressed concern relating to construction noise, debris and construction workers parking along the fence line of his home impacting his family’s privacy, and enquired whether the applicant would be building a new fence line or is it the responsibility of the owner, and whether there has been an arborist report available to the public.

In response to Mr. Totino's enquires, Lucas Petricca, Planner, explained the number of trees designated for removal and replacement.

Jim Levac, Partner, Glen Schnarr and Associates advised that through site plan approval, perimeter fencing would be constructed and explained the approval process and requirements before determining timelines to build; and advised that the arborist report is available online,

Councillor Mahoney acknowledged the efforts of staff and the community over the years and is confident the applicant will provide a comprehensive plan to address the concerns of the community.

That Council acknowledges that the Commissioner of Planning and Building, in accordance with the Commissioner’s delegated authority, is contemplating approval of the draft conditions requested by the City, outlined in Appendix 2 attached to the staff report dated August 28, 2024 from the Commissioner of Planning and Building for the draft plan of subdivision under File 21T-M 24-5 W8 and that further draft conditions from other departments and external agencies be included prior to issuing draft approval.

       

    3. That the applicant agree to satisfy all the requirements of the City and any other external agency concerned with the development.

       

    4. That the decision of Council for approval of the rezoning application be considered null and void, and a new development application be required unless a zoning by-law is passed within 36 months of the Council decision.

The following person spoke:

  1. Wayne Coutinho, Korisak Urban Planning, provided an overview of the site location and neighbouring developments and infrastructure and explained the amendments proposed to the Official Plan and Rezoning application and illustrated the development concept and conceptual renderings.

In response to Councillor McFadden's enquiry regarding the cost sharing agreement for the sewer system, Aiden Stanley, Manager, Development North advised that cost sharing agreements with Branthaven Homes and Mattamy Homes were executed prior to the passing of the by-law and noted that there are negotiations underway with Your Home Developments for a cost sharing agreement.

Councillor McFadden noted that there is a resident in the neighbouring property to the development that Councillor McFadden would like to meet with the applicant and resident to address the concerns regarding issues relating to the construction and the density.

Councillor McFadden requested that the matter be deferred until a cost sharing agreement with Your Home Developments has been executed.
