Sacha Smith, Manager, Legislative Services and Deputy Clerk, called the meeting to order and called for nominations for appointment to the office of Chair for Planning and Development Committee for the term ending November 14, 2026. 

Councillor M. Mahoney requested that the Chair of Planning and Development Committee (PDC) be assigned on a rotating basis for one year and then be reviewed again by PDC. Councillors D. Damerla and S. Dasko expressed support for the rotation of the role of chair.

Councillors B. Butt and J. Kovac recommended that the committee continue with the appointment of one Chair.

Councillor D. Damerla departed at 6:13 PM.

    That the Chair of Planning and Development Committee (PDC) shall be a Member of Council assigned on a rotating basis for a period of one-year and then reviewed by PDC after the one-year, and further that the Council Procedure By-law be amended to reflect the assignment of the Chair.

"We acknowledge the lands which constitute the present-day City of Mississauga as being part of the Treaty and Traditional Territory of the Mississaugas of the Credit First Nation, The Haudenosaunee Confederacy the Huron-Wendat and Wyandotte Nations. We recognize these peoples and their ancestors as peoples who inhabited these lands since time immemorial. The City of Mississauga is home to many global Indigenous Peoples.

As a municipality, the City of Mississauga is actively working towards reconciliation by confronting our past and our present, providing space for Indigenous peoples within their territory, to recognize and uphold their Treaty Rights and to support Indigenous Peoples. We formally recognize the Anishinaabe origins of our name and continue to make Mississauga a safe space for all Indigenous peoples."

At this time Councillor S. Dasko took over as Chair and recited the Indigenous Land Statement.

Councillor C. Parrish spoke to the sign variance application provisions and requested that the application be approved.

    2. That should Planning and Development Committee (PDC) decide to approve the application, that the existing ground sign located on the subject site shall be removed.

Ameena Khan, Planner provided an overview of the Potential City-Initiated Amendments to Zoning By-law.

The following person spoke:

  1. Sue Shanly, President, MWRRA spoke to her written correspondence and expressed concerns regarding the potential air and light pollution risks.

Councillor C. Parrish enquired if marijuana was included in the amendment and moved the recommendation and requested that the Recommendation Report be brought directly to a future Council meeting. Councillor J. Kovac requested that the report come back to the Planning and Development Committee instead of directly to Council. A. Khan and Andrew Whittemore, Commissioner, Planning and Building responded to questions.

Matthew Shilton, Development Planner provided an overview of the Official Plan Amendment, Rezoning and Draft Plan of Subdivision applications.

The following persons spoke:

  1. Jenny Pino, Resident expressed concerns regarding the widening of the road and the community engagement. J. Pino enquired about who has the authority to make decisions to build the homes before widening Ninth Line and further enquired about the street boards. 
  2. Brennan Bempong, Resident suggested that there be more community engagement regarding this application.

Councillor A. Tedjo enquired about the multi-use trail in the area. M. Shilton and Andrew Whittemore, Commissioner, Planning and Building responded to questions.

Councillor S. McFadden spoke to the history of the application and the previous community engagement. Councillor S. McFadden further requested that the Recommendation Report be brought directly to a future Council meeting.

    1. That the applications under Files OZ 20/021 W10 and OPA 22-011 W10, Mattamy (5150 Ninth Line) Limited, 5150 Ninth Line to amend Mississauga Official Plan to Residential Medium Density; to change the zoning to RM6 - exception (Townhouses on a CEC Road – Exception), RM11- exception (Back to Back Townhouses on a CEC Road – Exception) and G (Greenlands) to permit 42 back to back townhomes and 4 condominium townhomes on condominium roads, be approved in conformity with the provisions outlined in Appendix 2 of the staff report dated October 28, 2022 from the Commissioner of Planning and Building.
    2. That Council acknowledges that the Commissioner of Planning and Building, in accordance with the Commissioner’s delegated authority, is contemplating imposing the draft conditions of approval outlined in Appendix 3 attached to the staff report dated October 28, 2022 from the Commissioner of Planning and Building for the draft plan of subdivision under File T-M20005 W10.
    3. That the applicant agree to satisfy all the requirements of the City and any other external agency concerned with the development.
    4. That the decision of Council for approval of the rezoning application be considered null and void, and a new development application be required unless a zoning by-law is passed within 36 months of the Council decision.
    5. That notwithstanding subsection 45.1.3 of the Planning Act, subsequent to Council approval of the development application, the applicant can apply for a minor variance application, provided that the height, number of dwelling units and FSI shall not increase.
    6. That notwithstanding planning protocol, that the Recommendation Report be brought directly to a future Council meeting.

David Breveglieri, Planner provided an overview of the community benefits contribution.

The following person spoke:

  1. Deborah Goss, Resident expressed the need for community engagement with respect to community benefits and park funding. D. Goss further enquired about how the funding was determined and requested that a community working group be established.

Councillor S. Dasko spoke to the history of the community benefits contribution and the community engagement process. Councillor S. Dasko enquired about the opportunity for funds to be deployed to the new Lakeview community. D. Breveglieri and Andrew Whittemore, Commissioner Planning and Building responded to questions.

Councillor C. Parrish departed at 7:31 PM.

    That the report dated October 28, 2022, from the Commissioner of Planning and Building outlining the recommended Section 37 Community Benefits under File OZ 19/003 W1, Lakeview Community Partners Limited, 1082 Lakeshore Road East and 800 Hydro Road, be approved and that a Section 37 agreement be executed in accordance with the following:

    1. That the sum of $14,000,000.00 be approved as the amount for the Section 37 Community Benefits contribution.
    2. That City Council enact a by-law under Section 37 of the Planning Act to authorize the Commissioner of Planning and Building and the City Clerk to execute the Section 37 agreement with Lakeview Community Partners Limited, and that the agreement be registered on title to the lands in a manner satisfactory to the City Solicitor to secure the community benefits contribution.

Michael Franzolini, Development Planner provided an overview of the Official Plan Amendment and Rezoning applications. Councillor S. Dasko spoke to the community engagement process, expressed concerns with lack of parking, and expressed concerns with the proposed height. M. Franzolini responded to questions.

That City Council direct Legal Services, representatives from the appropriate City Departments and any necessary consultants to attend the Ontario Land Tribunal hearing on the subject applications under File OZ/OPA 22-5 W1, 128 Lakeshore Road East LP, 128 Lakeshore Road East to permit an 11 storey condominium apartment building containing 42 units and commercial uses at grade in support of the recommendations outlined in the report dated October 28, 2022 from the Commissioner of Planning and Building, that concludes that the proposed official plan amendment and rezoning are not acceptable from a planning standpoint and should not be approved.
    2. That City Council provide the Planning and Building Department with the authority to instruct Legal Services on modifications to the position deemed necessary during or before the Ontario Land Tribunal hearing process, however if there is a potential for settlement then a report shall be brought back to Council by Legal Services.
